Beyond Notice and Takedown: Disrupting a Counterfeit Supply Chain

Leading educational and trade publishers, association publishers, and smaller independent publishing houses were facing a growing threat of counterfeit versions of their books being sold through major online marketplaces, used bookstores, and other downstream resale channels. 



Working in close coordination with senior executives, in-house legal teams, and outside counsel, BCGuardian developed and executed a tailored intelligence and enforcement strategy that moved beyond routine notice-and-takedown activity and toward major illicit market disruption. 



The result: a court-ordered raid, the seizure of more than 100,000 counterfeit books otherwise bound for market, and additional seizures of inbound international shipments through collaboration with U.S. Customs and Border Protection.

Counterfeit books had become increasingly visible across online marketplaces and physical resale channels. These books were unlawfully produced, often in international markets, and then introduced into the U.S. market through distributors, resellers, and marketplace sellers. 



Such counterfeit books eroded legitimate sales, damaged trusted distribution channels, and created confusion in the marketplace 



Traditional enforcement tactics could remove listings or address isolated sellers, but they did not always identify the root source of the counterfeit inventory. Our clients needed a strategy that could connect marketplace activity, physical inventory, distribution channel partner relationships, and import activity into a coherent evidentiary record. 



BCGuardian was retained to develop a program to identify the upstream sources, document the activity in a forensically sound way, and support legal action capable of producing a meaningful market impact.

We built a multi-channel intelligence program designed to identify patterns, trace supply, and preserve evidence. The work included persistent monitoring of suspicious offers across major online marketplaces, supported by hundreds of test purchases. 



At the same time, we coordinated with a trusted network of distributors who were surrendering counterfeit books and identifying parties involved in the unlawful supply of those works. This created a second intelligence stream outside of online marketplace monitoring. 



By combining digital marketplace intelligence with physical inventory review and coordination with legitimate market participants, we identified common threads pointing to an importer bringing counterfeit books into the United States from overseas.

Once the supply pattern became clear, we developed an evidence package to support litigation by our clients’ outside counsel. 



The package connected marketplace activity, test purchase results, surrendered inventory, other distributor intelligence, and suspected import activity into a record that could support decisive legal action.

Our team accompanied U.S. Marshals during a court-ordered raid of the unlawful distributor’s facility. The action resulted in the seizure of more than 100,000 counterfeit books, with an estimated value exceeding $10 million. 



After the seizure, our operations team led the boots-on-the-ground effort to inspect, verify, and catalog every unit as evidence. 



As the matter progressed, we helped expand the enforcement net. Working with U.S. Customs and Border Protection, we supported the continued seizure of inbound international shipments bound for the distributor, collectively accounting for thousands of additional counterfeit books.

The engagement delivered a major disruption to a counterfeit book supply chain.

The work helped our clients to move from reactive enforcement against individual listings to a larger, source-focused strategy to amplify the reach of their content protection programs.
